The question
We are a group of residents in Mena AR. A new plant has moved to our area about 4 months ago and they make Pine shavings. They have a high pitched whine machine that invades our neighborhood. Mena has no noise ordinance and the city council says there is nothing they can do. The site is an industrial site. They run 16 hours out of 24. The noise generated by this company very loud, altho they say it is a legal level .We feel listening to this constant whine for 16 hours is damaging to our health/hearing. When they run at night, it is difficult for some to sleep..impossible to sleep with windows open//some people put cardboard over windows tape around doors--run extra fans to lessen the noise--when they run in the day it is very annoying outside our homes. We feel our property value has dropped greatly, and near impossible to sell to relocate, due to this noise Do we have a case for legal action?
