Do I have a wrongful termination case?
I have worked for ETSU for 5 years. I have always received good reviews. I was a site coordinator for a speech and hearing clinic. After contracting covid, I had to have an accommodation for work, intermittent leave, and currently full FMLA leave starting Nov 1. Today, I was called in to meet with my supervisor and was given a termination letter dated Nov 13. The reason is for restructuring the dept. They eliminated my position, however they are posting a job for someone to do my job duties, just with a different job title. Is this legal?

What right to post-employment testing for exposure to Benzene and heavy metals do I have?
Hi, I work in the hazardous waste industry. I was tested for pre-employment baseline in 2021 then I finished my year long contract. I was never offered post-employment testing to monitor any exposure. I am now three weeks into a new contract with the same employer who forgot to do my pre-season baseline this year. They are requesting I establish a new baseline that would disregard all exposure from my previous contract and the first few weeks of this contract.

I had been a contract employee at a major news organization from Sept. 2016 to Sept. 11, 2023. Because I had been working on contract, I was forced to take hiatuses between my 12- to 18-month assignments. My last contract ended March 27, 2023. I was expecting, as usual, another contract starting in July. But instead, the company brought me back on only a three-month freelance gig. On Aug. 11, they said I would get a contract starting in October. But on Sept. 6, they told me they would be cutting my hours in half due to some technicality -- which was never explained to me -- as of Oct. 1. Then, last week, they fired me altogether -- again, without fully explaining why. I have done excellent work for the company, according to my boss, and I have worked hard and have been loyal. I'm over 65, but so is my boss, so I doubt it's an age thing. I'd just like to know why this happened. My boss, who is an ally, seems to be under some kind of gag order. Do I have any kind of case?

Can a company that has 12hr and 8hr employees change overtime rules from low hours which was fair to everyone to 12hrs cover 12hrs and 8hrs cover 8hr
I work in maintenance for 30years and the overtime rules went by hours regardless of shift that way no one could manipulate overtime. Maintenance overtime rules worked so good that the rest of the plant adopted those rules. Now the maintenance department head changed the rules to 12hr employees cover 12hr employees and 8hr employees cover 8hr employees regardless of hours. Now an 8hr employee can work overtime with high hours and get more overtime opportunities than a 12hr employee.

Do I have a cause of action in regards to separation from my job?

My employer has posted a statement threatening all employees with termination for discussing out pay rates amongst each other how should I proceed?
In addition to what was stated above my current employer has refused to pay me for daylight savings time. and on multiple occasions "messed up" my pay rate or hours worked. I have to contact them multiple times about correction, leading me to believe all this is on purpose and a way to get out of paying me my full pay rate and full hours worked. I was let go from my Position as General Manager(salaried employee) from Club 4 in Flower Mound. I was home recovering from Emergency Gallbladder surgery under a Doctors care with Documentation provided to employer stating my limitations and when I could return, After they received my Doctors note. My immediate supervisor scheduled a quick call with me. Quick talk stated that due to fact that current moment I was not capable of performing all duties required, They wanted to go ahead and part ways for they found replacement for me. My limitations was not being able to lift over 15 Lbs Until June 13th from my Surgery Done on May 15th but could resume all other functions May 30th. This call was done on May 24th 6 days before I was to return to work.

Can an exempt employee be denied Holiday pay if under the 90 probationary period at start of hire?
I am an exempt employee recently hired in Sacramento, CA. My employer deducted one days equivalent pay from my paycheck for the Memorial Day holiday as company policy is not to pay Holiday pay for the first 90 days of employment. Is refusal to provide hospital records/police report following an accident considered cause for termination
Was in a car accident Saturday and missed work. I understand NY employment is at will and understand they can term me but would it be considered cause or are they obligated to follow through with my contract and provide me w the provisions noted for termination without cause (60 days pay, pay out my time off balance etc). They are giving me the option to resign which I suspect is because they want me to go that route to avoid paying >$25,000 in severance.
