I want to withdraw my child from Special Education

I'm moving school districts. Right before I withdrew her she got arrested for threatening in 2nd degree over a snapchat, not to anyone in particular though. She was suspended for 5 days. I withdrew her but the new school won't enroll because apparently the complaint came from a student at that school. They want to place her in a special program at another school. I do not want her to be placed in a special program at all. I'm thinking of withdrawing her from special ed altogether. She hates paraprofessionals hanging over her, won't talk to the counselors and hates being pulled out of class. She is perfectly capable of doing the work in a regular setting as long as she applies herself. We can get a tutor for her otherwise. Right now she is placed in an alternative ed program while we decide what to do. Can I legally refuse special ed?

Do I have the right to an independent psychological evaluation of my 5 year old son? Can his school evaluate him without my consent?

We are in the Irvington, NY school district. My son, kindergarten age 5, has kicked his teacher and threatened her and has hit an aid. We want him evaluated independently as we do not trust the school psychologist. She kept him sitting on the floor of her office for over 2 hours because he refused to speak to her. He eventually blurted out that he was going to booby trap the school. She then asked if he wanted to hurt people. Which he said yes. Her next question was if he wanted to kill people in the school. He again angrily replied yes. He was not allowed back into his class and eventually sent to the principals office where she asked if he wanted to hurt people and he replied, 'of course not'. A couple days later he was suspended for telling his teacher that he wanted to kill her (we feel this came directly from the psychologists questioning). The psychologist has told us that she thinks he is a threat to the school and we do not feel that she is competent.

Do I have any recourse against a private religious school that is kicking out my child for behaviors stemming from ADHD?

My child is diagnosed with ADHD, he has been in the school for seven years. In the beginning, he used to throw chairs and desks, he has thrown a hockey stick at a gym teacher, he has been physical with other children in the school. Over the years his behavior has improved but he still continues to have issues. He sees a therapist outside school once a week and twice a week in school. He is medicated and his has a full time shadow in school with him all day. Any time the school has asked us to do anything we have responded yes and have jumped through all of their hoops. They have requested a meeting with us tomorrow and we suspect they are going to kick him out of the school.
